Courts of exception and constitutional emergency: the debate on the National Security Court

Abstract

The objective of the article is to reconstruct, from the perspective of constitutional history, the legal discussion that took place between 1936 and 1937 about the National Security Court (TSN). The text seeks to identify the arguments used by Parliament and the Supreme Court to legitimize a court of exception in the face of the limitations established in the 1934 Constitution. Primary sources are analyzed, with special focus on the Legislative Branch Gazette and some habeas corpus cases.
